Job Description

The Virginia Department of Alcoholic Beverage Control is seeking an experienced professional to provide legal and policy guidance to the agency’s Bureau of Law Enforcement. Specific duties and qualifications are as follows:

DUTIES:

Legal-This position will represent the interests of the Bureau in connection with initial hearings before an ABC hearing officer and appeals to the ABC Board under the Virginia Administrative Process Act. This position may also negotiate settlement of disciplinary cases at the agency level through the offer in compromise process. Additionally, this position will provide general legal guidance to the Bureau on law enforcement operations and matters, and serve as the Bureau point of contact with the OAG.

Training-This position will help to design and provide training for Bureau leadership and personnel related to investigative, regulatory, and procedural matters.

Policy/Legislative/Regulatory-This position will also provide technical support and guidance in the development of policy, legislative, and regulatory proposals for the agency. Additional duties include reviewing and interpreting regulations and statues applicable to ABC operations and programs to ensure agency policies are uniform and internal guidelines are in compliance with the law.

Minimum Qualifications

Qualified applicants should have working knowledge of the legal system, administrative hearings governed by the Virginia Administrative Process Act, operations/processes of legislative committees, risk management issues and
legislative and regulatory processes at the federal and state level. The demonstrated ability to conduct legal and policy research; manage multiple cases in various stages of completion; work with enforcement authorities to build a case, properly try a case before a hearing examiner or on appeal before the ABC Board; manage policy analysis and development; communicate effectively both orally and in writing; analyze problems and develop solutions; assist in
guiding managers and supporting agency initiatives and objectives; identify issues at the national level impacting the operations of the agency; and maintain effective working relationships with agency employees, businesses,
organizations, trade groups, licensees, and government officials is paramount. Proficiency with personal computers and current software applications is needed as well as experience drafting, editing and negotiating contracts; analyzing agency procurement acceptance; managing multiple assignments; organizing and coordinating work activities across a diverse group of people and special interest groups; and collecting, compiling and accurately analyzing data.

Required qualifications include membership in good standing with the Virginia State Bar. Preferred candidates will have an extensive knowledge of Virginia ABC laws and regulations and Virginia state government practices to include the legislative process.

The authority to perform duties that involve representing ABC in the practice of law is contingent on the successful candidate obtaining an appointment as special counsel from the Office of the Attorney General of Virginia (OAG). ABC will facilitate a request for appointment of the successful candidate as special counsel, with the understanding that OAG has the sole discretion to make and continue such an appointment.
